Be Careful.. Misadvertisement and Huge Disappointment..
It's the builder's way our the highway..
Sales team my suggest that you don't need a lawyer, just send the money. Please make contact with a lawyer and have the lawyer go over all paperwork..
1. The building plan does not match the video. The builder refuses to what is on the plan and wants to "possibly" stick to what is shown in the video.
Finishes as per model unit is promised but not guaranteed. Therefore one can not be sure of what the finished product will look like..
2. Purchasers have no say has the builder provides no option for selection choices. Example a choice between 2 tile selections, color, countertop.. etc. You take what you get. No option to upgrade finishes such as taps, tiles, countertop.. etc. Recessed lighting, Airconditioning and Ceiling fans are considered as upgrades. No warranty and make to determine quality.
3. The builder requests a 10% downpayment, which only guarantees you a lot. No incentives are provided for forking over your hard earned cash for an inbuilt property.
4. Despite a downpayment the purchase price is only an estimate not a guarantee. Therefore a home costing $18.5 million can end up costing $26 million. In order to secure the advertised estimated cost one must deposit and pay the full purchase price in $$US dollar funds.
5. Major restrictions with the property.. Example in the backyard trees can not be taller than the fence and in the front yard trees/bushes can not be higher than 2 feet.
6. Safety concerns.. Some back yards are facing the road. There is no barrier between the backyard fence and road. So any unwelcomed guest(s) can simply hop over and create havoc.
7. No clear number of how much or if a reserve fund will have a stated figure.
8. No information provided as to where if any a reserve fund amount will come from. Example" Each household will be required to pay an additional $100,000 allocated to the reserve fund. Therefore at the end of building and collection we expect to have an estimated $2.5 million US..etc. Be prepared to fork over more cash..
9. The swimming pool is quite undersized for the size of the planned community.. Maybe the builder sticking to their current advertised plan and providing a bathtub may offset the extremely undersized swimming pool. Both I strongly doubt that they will and doubt that that issue will be rectified. Homeowners will be paying maintenance fees for things they may or not have the full potential uses of..
Issues with completed homes..
A. No eavesdropping or water run offs installed on the roofs. Therefore water pools around the foundation and walk ways. It would be interesting to know the damage that unsuspecting homebuyers will face in the future as a result.
B. Unfinished driveways with no timeline of a completion date.
C. Shower floors are not sloped towards the drain. So meanwhile you take a shower so will the house and its contents as water runs into adjacent rooms.
D. Cracks are beginning to show already in some homes. With the homeowner most likely fitting the bill.
This might be better as an investment for a quick flip or rental.. But all and all a big risk.. One maybe better off waiting to see the finished product and leaving their 10% deposit in the bank. This way you might get some small interest and one will know what they are getting..
Builder needs to correct misadvertising and provide clear information and incentives to potential buyers.

This will be a very nice gated community, with very nice views of the Caribbean sea accompanied with a pool, gym, tennis court and and soccer field.
