Also, this advertising harms the consumers of advertising, in particular, by increasing the noise level. According to Art. 21 of the Law of Ukraine "On Atmospheric Air Protection": in order to prevent, reduce and achieve safe levels of industrial and other noise should be provided, in particular, organizational measures to prevent and reduce industrial, municipal, domestic and transport noise, including the introduction of rational schemes and traffic regimes transport and other mobile vehicles and installations within settlements ". The installation of so-called "street radio" does not help reduce noise. On the contrary, constant voice messages can harm the occupants of nearby houses, including interfering with their privacy and thus violating the Constitution of Ukraine and Article 8 of the European Convention on Human Rights. According to Part 3 of the Regulation on the State Service of Ukraine for Food Safety and Consumer Protection, approved by the Cabinet of Ministers of Ukraine dated September 2, 2015 № 667, the State Food and Consumer Service in accordance with its tasks, in particular: take part in identifying factors that may have a detrimental effect on human health, in conducting risk assessments and determining the degree of risk they pose; monitors compliance with the legislation on advertising in terms of protection of the rights of consumers of advertising, decides on the recognition of advertising unfair, hidden, on the recognition of comparisons in advertising illegal with the simultaneous cessation of its distribution.
