I cannot make any further statements about Ms. Köhler's work as such, except that we were unsuccessful in our civil law matter, which is of course annoying, but it is also part of the fact that proceedings can also be lost. Above all, the application should refer to the fee note .. since Ms. Köhler made public consultations in the Vienna Bar Association, she made a very trustworthy impression and we therefore tackled the matter quickly and decisively. A lump sum was set as the fee, which I and one of my employees (to whom this civil law matter was concerned) can testify. This was also confirmed often enough by Ms. Köhler and so we also signed the small print power of attorney WITHOUT reading it again in detail in the confidence that something was discussed again there anyway. In the end it is our fault, because we only found out afterwards (when the bill was almost 3 times as high) that we had signed the power of attorney with payment in accordance with the RATG (Lawyers' Tariff Act). The unpleasant thing is that we have no evidence, because Ms. Köhler suddenly denies that a lump sum has ever been agreed and that she has never done this either. The power of attorney that we were given to sign naturally also shows that no lump sum was agreed. Something like that leaves a very bitter aftertaste ... and I can only recommend: Better make sure 5 times whether what you sign is what was discussed orally. At the same time, it would have helped us to record the conversation on tape, so that afterwards we would have proof of the agreed fee. Ultimately, I was more annoyed with myself because I made the classic mistake due to trust and didn't read the power of attorney carefully enough.
