Although good THEORETICAL information, the AK cannot really help - at least often not!
Unfortunately, my ex-boss was himself a lawyer and refused to pay out 3 days of vacation after giving notice and he let us work in unjustified minus hours (correctly we shouldn't have written a minus (Ordi just opened later and closed earlier in the summer slump), but registered ours. Let us work for hours or leave us at home WITHOUT minus! We have often said that we still want to come and have no minus- HIS answer: have it right back in winter!
yes, but then it would have been overtime u not compensate / work off the minus that we had involuntarily built up before!
there was always enough to clean, tidy up, sort out expired medication, etc. in a large ordination!
I couldn't get my overtime back despite official transcripts ... as soon as you as an employee "declare yourself ready" u write minus as minus (if you refuse but the job is about to start!) boss can only be asked to do so by registered mail Vacation and overtime paid .. despite this letter from the AK, my ex boss was completely unimpressed because he knew that the amount was "too low" for a (probably hopeless) lawsuit !!
Back then (~ 2017) it was a few hundred euros for ME, peanuts for HIM ... on the other hand, as AN you have zero chances, the whole consultation doesn't help because it's lost time and in the end nothing comes of it! - except that HE was probably still rubbing his hands while I was looking through the fingers !!! .. I wonder why these great labor law laws, if the DN stays over in most cases anyway ?!
I called the parental leave department today. The gentleman there was very nice and was able to answer most of the questions with great. To be on the safe side, he forwarded me to the maternity leave department. The lady there was also very nice and, due to the complicated matter and the proximity to my main residence, decided that I should make an appointment in Floridsdorf in order to be able to advise me as best as possible. She connected me to Floridsdorf to make an appointment and then I was shocked by two such positive experiences to come across the complete opposite:
I explained to the lady that I would need an appointment for a personal consultation about maternity leave. The answer was "Well then call maternity leave, I'll give you the number". The lady gave me the number / extension I called at the beginning and called the nice gentleman. So I explain to her that I have already phoned these offices and that maternity leave put me through to her to make an appointment. The answer was "I'm not the maternity leave, I'm the secretariat"
Well, thanks for NOTHING! Unfortunately, I don't know the name of the lady in the secretary's office, but maybe you'll cut yourself off from your colleagues. I know myself through my job that the times of crisis are really not easy at the moment. Solution-oriented work should be expected from the Chamber of Labor! If the secretariat is not responsible for making appointments on the advice of the responsible department, I wonder what your job should be ...
Info was very competent legal advisor had to read through until the info came, but that's not a mistake .... I'm satisfied
This legal advice is a joke. Short appointments, where the details are not dealt with at all and where it is more important that the employee comes to her language course in the afternoon in time. If this is supposed to be an employee representative body, then I can only be surprised. I advise everyone to find their own lawyer where their concerns are in good hands.
