Had a bad tenant damage my house and then run away owing back rent , tried to lodge a claim with GIO Landlord insurance where I believed I had to pay a $100 excess only to find that they want the standard excess of $100 plus they want $500 excess to claim lost rent and then another $500 excess to claim for the damages the tenant caused and when I asked what they need me to send them etc. they siad that they want a copy of the lease which is fair enough plus other things and they want me to lodge with NCAT but I have no idea why I have to deal with these people I have an abandoned house which has been damaged and I cannot see how some tribunal is going to help or change anything. they wrote to me today apparently I have a telephone hearing scheduled for late February and how that iwll help anything is beyond me.

Waste of tax payers money. I had a folder full of evidence and the member did not even look at it. This place cements that there is no such thing as consumer rights within Australia. Suppliers do not have to abide by the laws set out by the department of fair trading. They should get rid of NCAT and allow you to go to court where the court actually looks at the presented evidence and not hear say. The end result for me was I go a portion of my money back and I have to fabricate and fix the items myself. The money I received will not even cover the cost at all. The installer got to walk away and now I am left with his problem and my warranty will now be void as I have to fix it myself. NCAT is set up to protect these companies, so they can continue ripping the consumer off. Please shut NCAT down and give the consumer a chance to go to a real court and get a real judgment based on the facts. You cannot contest NCATS decision once it is made as they have to approve it. If the decision made is not complied with by the party NCAT will let you go back, However you cannot talk about any of the previous issues.
