Atradius delivers a default, and unfortunately that is the “positive” that can be reported about Atradius. Truncated original review dated December 19, 2017: My assignment to Atradius is from June 28, 2017, it concerns a collection abroad. After an amicable settlement failed (partly due to Atradius 'bumbling), I ordered October 6, in accordance with Atradius' recommendation, to enter the “legal phase”. For this I also paid an advance of € 3350.00. Atradius confirmed that the legal process was underway, and informed me on October 24, November 8, and November 29 about the progress of the lawsuit (including the story that the court had requested another document and that it had been sent in the meantime). November 29 there was bad news: an unforeseen legal / procedural hitch. But… no man overboard, Atradius saw more possibilities. Unfortunately for the costs that are paid from the advance, but yes: there is a risk in legal proceedings. However, I noticed an inconsistency in the story of Atradius. From that moment on it crumbled. At the end of the conversation, it was already acknowledged that the “procedural error” had been discovered before the documents were brought to court (and so “possibly” the advance “would not have been used up”). Two weeks later (December 18) Atradius acknowledged that there has never actually been a lawsuit or its preparation. I lodged a complaint and recovered the advance. Atradius reacted with irritation (to the “lack of confidence”), suddenly saw no more possibilities for a successful collection and announced that he would close the file. Update January 24, 2018: Atradius has prepared a letter saying that I have withdrawn the order and demanded that Atradius cease work. In an email Atradius announces that it will send the final invoice (this can be done contractually when the customer withdraws a direct debit). In a phone call at the back, Atradius offers to withdraw that invoice, provided I also withdraw my complaint. That phone call immediately threatened that if I did not pay and also did not withdraw my complaint, I would enter a "tedious process", possibly ending in a basic procedure. Summarized: 1) For almost two months Atradius continues to claim that a lawsuit is pending against the debtor (I have this in writing). Evidently incorrect: I have a written statement from the lawyer that Atradius has taken on for this case, stating that the petition has never been drawn up in court. 2) Atradius states that I have withdrawn the assignment. Evidently incorrect: My correspondence with Atradius has always been aimed at continuing the collection. 3) There is a lack of confidence. Misleading: Atradius has betrayed my confidence. I have never betrayed Atradius' confidence. 4) The withdrawal is without valid reason and the invoice is therefore justified. Incorrect and Misleading: The revocation is indeed without valid reason, but it is Atradius who revoked it, not me. Atradius has thus de facto unilaterally dissolved the agreement. In the event of a dissolved agreement, it is no longer justified to send an invoice based on the conditions of that agreement. 5) It seems that Atradius has attempted to deduct notional (legal) costs from advances paid (in the expectation that the stories about procedures abroad cannot be checked by the customer anyway). These are practices that do not suit a bona fide organization. Update February 20, 2018: Atradius credited this note two weeks after they sent the final bill.
