I hired Freya Katkowsky to help my Chinese born wife through the Green Card process here in Madison. This is not so much a review of Freya, she is a competent attorney, but to pass along what we learned. First, the $4000 dollar flat fee that seems to be the going rate covers nothing but completing the application. This is largely a waste of money unless you don't have the time or English skills to do it for yourself. If you want to be represented at the initial hearing that is an initial $1200 which is also a waste of money and can actually be detrimental. Attorneys can and sometimes do irritate the case officer. The case officer asks questions and the applicant, in this case my Chinese wife, responds. There is very little you can do to change anything that goes on at the initial hearing and there is even less that your attorney can do, except, make things worse by getting on the nerves of the case officer. As we learned, all case officers are not functionally equal, some are very good and some are very bad. We were unlucky in that we got a very bad one. Our case officer did not approve the initial request for a change of status and a Green Card. He wanted some ridiculous amount of additional documentation. To file an appeal against the case officer's findings requires either an hourly fee, set by your attorney, or you can negotiate a set fee to have the attorney handle the appeal process. This is probably the point at which you should hire an attorney. The appeal process cost us an additional $2000 and was successful. We had a very strong case going in and this shouldn't have been necessary but refer back to what I said about all case officers not being functionally equal. We elected to hire a different attorney for the appeal. In any event, my wife now has a Green Card and we are glad to be done with the whole ridiculous, expensive process.
